If your DUI arrest involved an accident, tell a lawyer about it
As with any arrest, do not talk to the police or anyone except your attorney about what happened. If you were in an accident, especially if there was property damage or an injury, law enforcement may want to make an example of you and your case.
Do not answer questions without the advice of a lawyer. What you say can be used as evidence against you.
- In a single car accident, there is usually no evidence about how it happened. Do not try to explain.
- Our law firm will follow all evidence to assure the chain of custody was preserved, especially when a blood test was administered.
- There can be multiple explanations for an accident and even for an elevated BAC (blood alcohol content) test. Did the driver drink before or after the accident?
- An injury can mean an enhancement of the charges.
If you were hurt in an accident, whether or not you were drinking, you are likely to be confused and not be able to give thoughtful answers. You will need medical treatment. If you are concerned that DUI will be suspected, make sure you focus on getting medical help for your injury and talk to a defense attorney as soon as possible.
